-
A declaration under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Action Upon Receipt of a Proper Notice
Once a valid DMCA notice is received, we may:
-
Remove or restrict access to the identified material.
-
Notify the content provider that their material has been removed or disabled.
-
Terminate Services for repeat infringers.
Submitting a Counter-Notice
If you believe that the material removed (or disabled) was not infringing, or that you had proper authorization to use it, you may submit a counter-notice to our Designated Agent including:
-
Your physical or electronic signature.
-
Identification of the material removed or disabled, and its location before removal.
-
A statement of good faith belief that the removal was due to mistake or misidentification.
-
Your name, address, phone number, and email (if available).
-
A statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., any district in which PineBly may be found) and agreement to accept service of process from the original complainant.
If a counter-notice is received, we may provide a copy to the original complaining party. Unless the copyright holder files a lawsuit, we may reinstate the material within 10–14 business days at our discretion.
